बड़वाह। नगर बड़वाह के नर्मदा मार्ग (इंदौर-खंडवा मुख्य मार्ग) पर एक ही जमीन के दो अलग-अलग सीमांकन पंचनामे सामने आए हैं, जिनमें बड़ा अंतर देखा जा रहा है। 2016 और 2025 में किए गए सीमांकन में अतिक्रमित भूमि के माप में बदलाव हुआ है, जिससे विवाद और गहराता नजर आ रहा है। हालांकि, मकान के मालिक दिनेश विजयवर्गीय का कहना है कि उनका मकान वर्ष 1950 से उसी स्थिति में मौजूद है, लेकिन 2025 के सीमांकन में प्रशासन ने वर्तमान चालू नक्शे के आधार पर इसे अतिक्रमण घोषित कर दिया।
2016 का पंचनामा
19 मई 2016 को तहसीलदार बड़वाह, राजस्व निरीक्षक और सीमांकन दल ने इंदौर-खंडवा मुख्य मार्ग की चौड़ाई की नाप-जोख की थी। इस दौरान दिनेश विजयवर्गीय को 4.60 मीटर × 4.70 मीटर (कुल 21.62 वर्गमीटर) भूमि पर अतिक्रमण का दोषी पाया गया। प्रशासन ने उन्हें 23 मई 2016 तक अतिक्रमण हटाने का नोटिस भी जारी किया था।
2025 का पंचनामा
20 फरवरी 2025 को बड़वाह अनुभाग के अनुविभागीय अधिकारी (राजस्व) के आदेश और मध्य प्रदेश उच्च न्यायालय, इंदौर के निर्देश के बाद, एक नया सीमांकन किया गया। इस बार प्रशासनिक दल में स्वास्थ्य अधिकारी, सहायक यंत्री, उपयंत्री, राजस्व निरीक्षक और पटवारी भी शामिल थे। इस नए सीमांकन के अनुसार, दिनेश विजयवर्गीय का गृह 4.70 मीटर × 3.70 मीटर (कुल 17.39 वर्गमीटर) भूमि पर अतिक्रमण किए हुए पाया गया।
क्या कहता है अंतर?
- 2016 में अतिक्रमण का क्षेत्रफल 21.62 वर्गमीटर था, जबकि 2025 में यह 17.39 वर्गमीटर बताया गया।
- चौड़ाई समान (4.70 मीटर) बनी हुई है, लेकिन गहराई 4.60 मीटर से घटकर 3.70 मीटर कर दी गई।
2016 के पंचनामे में दिनेश विजयवर्गीय को मौके पर ही अतिक्रमण हटाने की सूचना दी गई थी, जबकि 2025 में उन्होंने सीमांकन पर असहमति जताई और पंचनामे पर हस्ताक्षर किए।
अब उठता है यह सवाल
1. सीमांकन में बदलाव क्यों हुआ? क्या 2016 का सीमांकन गलत था, या फिर 2025 में कोई प्रशासनिक दबाव है?
2. क्या नक्शे में बदलाव हुआ? अगर हां, तो इसका आधार क्या है?
3. अतिक्रमण कम कैसे हुआ? क्या दिनेश विजयवर्गीय ने 2016 के बाद कुछ अतिक्रमण हटा दिया था, या फिर यह सिर्फ दस्तावेजी अंतर है?
4. न्यायालय की भूमिका क्या है? चूंकि यह मामला उच्च न्यायालय के आदेश से दोबारा सीमांकन के लिए खोला गया, तो क्या इसमें किसी तरह की कानूनी अनियमितता है?
अब आगे क्या?
अब प्रशासन को यह स्पष्ट करना होगा कि आखिर दोनों सीमांकन में अंतर क्यों आया? अगर अतिक्रमण का माप कम हुआ, तो 2016 के सीमांकन की विश्वसनीयता पर सवाल उठता है। वहीं, अगर 2025 का सीमांकन सही है, तो 2016 के पंचनामे पर की गई कार्यवाही पर पुनर्विचार जरूरी होगा। क्या यह प्रशासनिक चूक है या किसी दबाव में सीमांकन बदला गया? यह जांच का विषय है।
इनका कहना है
उच्च न्यायालय के आदेश अनुसार राजस्व और न.पा. की टीम ने मकान का सीमांकन किया है। जिसकी जाँच रिपोर्ट आने पर न्यायालय में पेश की जाएगी, हालांकि 2016 और 2025 के सीमांकन का अंतर भी जाँच रिपोर्ट आने के बाद ही स्पष्ट होगा।
तहसीलदार शिवराम कनासे
राजस्व और नपा टीम ने उच्च न्यायालय के आदेश अनुसार सीमांकन किया है। इस सीमांकन के आधार पर करीब तीन मीटर मकान का अतिक्रमण बताया जा रहा है।
